Chicago (IL) – Take-Two Interactive has reportedly sued Apogee Software’s 3D Realms over the company’s failure to develop “Duke Nukem Forever.” According to Take-Two, Apogee breached a mutual agreement which stipulated the production and design of a new Duke Nukem sequel.
“Apogee continually delayed the completion date for the Duke Nukem Forever,” Take-Two said in a complaint obtained by Bloomberg. “Apogee repeatedly assured Take-Two and the video-gaming community that it was diligently working toward completing development of the PC Version of the Duke Nukem Forever.”
3D Realms began designing Duke Nukem Forever in 1997. However, the company, which was based in Garland, Texas, terminated the project and shuttered its studio on on May 6, 2009.
Take-Two apparently paid Apogee $12 million for Forever’s publishing rights in 2000. An additional agreement was signed in 2007 for an unspecified amount.
