The UK’s Regulation of Investigatory Powers Act (RIPA), which gives government broad access to e-mail and other Net communications, may be in violation of the European Union Human Rights Act, just incorporated into UK law. The RIPA gives British authorities the right to install systems similar to the US FBI’s currently debated Carnivore e-surveillance system, and establishes severe penalties for refusing to turn over encryption keys to authorities. Article 8 of the Human Rights Act, however, specifically states that “everyone has the right for his private and family life, his home and his correspondence.” The law also allows citizens to challenge the RIPA in UK courts and such challenges are expected.
